A payment default record, in Finnish maksuhäiriömerkintä, is an entry in a credit information register showing that an invoice or debt has remained unpaid and the matter has progressed far enough in collection, court proceedings, enforcement or debt restructuring.

The most important point is this:

One late invoice does not usually create a payment default record.

A record can arise if invoices, reminders, payment demands, a summons or enforcement letters are ignored for too long.

For light entrepreneurs and sole traders, the practical distinction is this:

A payment default record does not mean that working, entrepreneurship or invoicing must stop. It means that contracts based on trust and credit checks can become harder. That is why it is worth preventing a record early and dealing with it quickly if one already exists.

2. A payment default record does not appear immediately after a late invoice

Many people worry that missing one due date means losing their credit information immediately. In Finland, that is not how it usually works.

Before a payment default record appears, there are normally several stages:

  1. The invoice falls due.
  2. The creditor sends a payment reminder.
  3. The matter may move to debt collection.
  4. You receive payment demands or other notices.
  5. The matter may move to court or enforcement.
  6. In certain situations, a payment default record is entered in a credit register.

According to Oikeus.fi, the creditor must notify the debtor, or at least try to reach them, if the debtor is at risk of receiving a payment default record. The credit register keeper always informs the person in writing about their first payment default record.

In practice, many problems grow because letters, emails or debt collection messages are left unanswered. If the invoice is valid but you cannot pay it immediately, contacting the creditor is usually better than silence.

3. How can a payment default record arise?

A payment default record can arise in several ways. The Finnish Competition and Consumer Authority and Oikeuspalveluvirasto highlight situations such as these:

According to Oikeuspalveluvirasto, a record can appear at the earliest about two months after the due date. The timing still depends on the type of debt and how collection proceeds.

If you believe the invoice is wrong, respond in writing immediately. Disputing a claim does not mean ignoring it. Tell the creditor or collection agency which part of the claim is incorrect and why.

4. What can a payment default record affect?

A payment default record matters especially in situations where the other party assesses your credit risk. It can make it harder to:

  • get a credit card or loan
  • enter into an instalment agreement
  • rent an apartment
  • get home insurance or another insurance policy without paying upfront
  • open a phone subscription without a deposit
  • get certain jobs, if the role involves financial responsibility
  • arrange business payment terms, financing or leasing contracts

According to KKV, even with a payment default record you have the right to basic banking services, such as online banking credentials. This is an important practical point: a record can make many contracts harder, but it should not cut you off from basic banking access.

If you already have a rental agreement, home insurance or phone subscription, the record usually does not affect those automatically as long as you keep current payments up to date. New contracts can be more difficult.

5. Light entrepreneur without a Business ID: does a record stop you from invoicing?

A payment default record does not automatically mean that you cannot work or invoice for your work through an invoicing service. If you invoice without your own Business ID, you are not contracting with the customer in exactly the same way as your own company would. The invoicing service handles invoicing according to its own service model.

In everyday life, the record can still matter:

  • opening a new phone subscription or insurance may require a deposit
  • renting a home may become harder
  • buying work equipment on instalments may become harder
  • some clients may check credit information if the work involves money, valuable property or confidential financial information

If you are a light entrepreneur and you have payment difficulties, the most practical thing is to separate two money flows:

  • income from work you invoice to customers
  • old personal debts, collection matters and any enforcement proceedings

6. Sole trader: why the record matters in practice

In Finland, a toiminimi is a sole-trader business form tied closely to the individual. According to Your Europe, a sole trader owns and manages the business personally, keeps the profits and is personally responsible for the business and its possible debts.

That makes a payment default record a very practical issue for a sole trader. The record can affect both personal life and the everyday running of the business:

  • getting a business account or payment services
  • phone and internet subscriptions
  • leasing or instalment agreements for work equipment
  • insurance
  • renting business premises
  • supplier payment terms
  • how customers or partners assess risk

For a sole trader, cash flow should be monitored before invoices become late. VAT, advance tax, YEL insurance and recurring business costs should be separated from personal spending money.

7. Business debts, tratta and sole traders

If you operate as a sole trader and buy services or products for your business, the debt may be a business debt. Business debt collection can differ from consumer debt collection.

One Finnish business debt collection concept is tratta. A tratta is a payment demand with the threat of public registration. Under the Finnish Debt Collection Act, a tratta may not be used to collect consumer debts. In other words, tratta belongs to business-to-business collection, not ordinary consumer invoices.

For a sole trader, this means in practice:

  • purchases made in the business name should be paid on time
  • an undisputed business debt can move through business collection faster than a consumer invoice
  • if you receive a notice about tratta, react immediately
  • if the claim is wrong or disputed, dispute it clearly, with reasons and in writing

Do not treat a tratta as an ordinary reminder. It is a more serious stage because it includes a publicity and credit information risk. If you do not understand the meaning of a letter you have received, contact the sender, your accountant or legal advice immediately.

8. What to do immediately if a bill may go unpaid

If an invoice or tax payment may go unpaid, speed matters. A practical order is:

  1. Check whether the invoice is valid.
  2. If the invoice is wrong, complain in writing immediately.
  3. If the invoice is valid but you cannot pay it, contact the creditor before the next stage.
  4. Ask for more time or a payment plan.
  5. Make sure the agreed payment plan is confirmed in writing.
  6. Pay critical ongoing costs on time, such as rent, insurance and essential work equipment.
  7. If the debt is already in collection, respond to the collection agency and ask for a breakdown of the debt.

According to KKV, you can ask the creditor free of charge for up-to-date information on the total amount and grounds of the debt. You can also request information from the collection agency.

If you have several debts and the situation is no longer under control, do not cover everything with new loans without a plan. Oikeuspalveluvirasto warns that paying bills and debts with new borrowing should be considered carefully, because it can deepen a debt spiral.

9. What to do if a payment default record already exists

If a record already exists, the situation is not over. The first step is to find out what caused the record and whether the underlying debt has been paid.

Act like this:

  1. Check which debt caused the record.
  2. Check whether the debt is still open, paid or in enforcement.
  3. If the debt is open, arrange a payment plan with the creditor, collection agency or enforcement authority.
  4. If the debt has been paid, make sure the payment information reaches the credit information register.
  5. If the record is wrong, request correction from the register keeper and provide evidence.
  6. If you cannot resolve the matter, seek help from financial and debt counselling.

With a payment default record, it is also important to keep new payments in order. Even if an old record affects your credit information, current contracts and essential bills should be paid on time so the situation does not get worse.

10. How long does a payment default record stay in the register?

Payment default records usually stay in the register for 2-3 years, but the exact period depends on the type of record. According to Oikeuspalveluvirasto, common three-year records include:

  • YVK, a default judgment in a debt matter
  • SVK, a judgment in a debt matter
  • UMV, lack of assets or another obstacle found in enforcement proceedings
  • UMS, lack of assets or another obstacle found in limited enforcement
  • UMP, a record related to long-term enforcement

The 2022 change is very important in practice: according to Oikeuspalveluvirasto, a payment default record is removed within one month after the register keeper receives information that the debt has been paid.

This does not always happen automatically. Often you must make sure that the payment information reaches the register keeper. Oikeuspalveluvirasto uses the REF notation for this, meaning that the debt has been paid.

In practice:

  • if the debt was paid through enforcement, you can ask enforcement to report the payment information
  • if the debt was not paid through enforcement, you can ask the creditor for proof of payment and send it to the credit information company
  • if the creditor reported the record, the creditor should report that the debt has been paid
  • because Finland has more than one credit information register, it is worth checking the information with the main register keepers

11. How to check your own credit information

You should check your credit information if you do not know whether a record is active, what caused it or when it should be removed.

According to Oikeus.fi, active payment default records and their validity periods can be checked from a credit information report. You can check the information free of charge once a year. The register keeper may charge a fee if you check more often.

In Finland, the key registers include:

  • the credit information register of Suomen Asiakastieto Oy
  • the credit information register of Dun & Bradstreet Finland Oy
  • the Finnish Tax Administration’s Positive Credit Register

The Positive Credit Register is not the same thing as a payment default register. It contains information about loans and income for credit-granting purposes, while payment default records are held in credit information companies’ registers.

If you have paid the debt but the record is not removed, request written proof of payment and contact the register keeper.

Does a payment default record appear immediately if an invoice is late?

No. A late payment alone does not usually create a payment default record. A record arises only if the matter progresses further, for example through a consumer credit default notification, a debt judgment, enforcement or a debt restructuring stage.

Does a payment default record prevent light entrepreneurship?

Not automatically. It can still make everyday contracts, equipment purchases, insurance or assignments harder if credit information is checked. If you invoice through an invoicing service without your own Business ID, the situation is assessed in practice through the service terms and the nature of the work.

Can I start a toiminimi if I have a payment default record?

A payment default record is not the same as a business prohibition. Starting a toiminimi may still be possible, but the record can make practical matters harder, such as banking, insurance, leasing and supplier agreements.

Can a toiminimi receive a business payment default record?

A sole trader operates personally and through their Business ID. In practice, both personal credit information and business-related credit information can affect how banks, suppliers and customers assess risk. That is why sole traders should keep personal and business payments especially well controlled.

Is the record removed immediately when I pay the debt?

Not necessarily on the same day. Under the current practice, the record is removed within one month after the register keeper receives information that the debt has been paid. Often you must personally make sure that the payment information reaches the correct register keeper.

Is a voluntary credit ban a payment default record?

No. A voluntary credit ban is not a payment default record. It is a voluntary restriction that can make it harder to take new credit and can help protect against misuse of personal information.

Who can help if there are too many debts?
